A little doubt about victory point

Hi to All!!!!!

Another think that is not very clear...

If in a battle you need 40 point to win...

1) You reach 41 and your enemy 38 = you win (this is clear!!)

2) You reach 50 and you enemy 45? We have always assumed that you win as
above but is correct? My doubt is if this should be a draw...

please let me know!!!
