For the record:
It is off topic to work on rules "loosely based on SM/Epic". NetEpic
was started on this list, but it was declared to be off topic by the
lords and masters of the list. This caused a little bitterness on the
part of some of the net epic people, BTW.
As it happens, E41K (being mainly expansion to E40K) is on this list,
and, at least so far, not been called "off topic".
As far as your question goes:
Assuming that you don't use GW text or images, there is diddly they can
do about it. Remember that copyright covers the expression of an idea,
not the idea it self. In other words I can write a fantasy novel that
has short, hairy footed human like creatures, but I can't call them
Hobbits. On the other hand, because they are part of the "western
mythical tradition" I can have Elves and Dwarves.
